These Terms of Service ("Terms") govern your access to and use of thepoolpolice.com (the "Site") operated by The Pool Police ("we," "us," "our"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

1. What this Site is — and what it isn't

The Site provides information about our pool cleaning and maintenance services in Austin, TX. No pool-service contract is formed through the Site. Estimates, quotes, scheduling, and service agreements happen by phone, email, or in person after you reach out to us. Any content on the Site is for general informational purposes only and is not a guarantee of service availability, price, or outcome for your specific pool.

2. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose.
  • Scrape, data-mine, or use any automated tool to access the Site at a rate that impairs Site operation.
  • Reverse-engineer, decompile, or attempt to extract source code from the Site beyond what is visible to normal browser users.
  • Republish or redistribute Site content (including photographs, logo, written content, and structured data) without our written permission, except for linking, brief fair-use citation, or search-engine indexing.

3. Intellectual property

All content on the Site — including text, photographs (including all photographs of Keith Mallette, team members, and serviced pools), logos, graphics, and the arrangement of the foregoing — is owned by The Pool Police or used with permission, and is protected by US copyright and trademark law. "The Pool Police" is our brand. You may link to the Site and share URLs freely. You may not use our logo, photographs, or name in a way that suggests endorsement without our consent.

4. Affiliate disclosure

Our /shop page contains affiliate links to products on Amazon.com. As an Amazon Associate, we earn a small commission on qualifying purchases you make after clicking through, at no additional cost to you. We only recommend products we have actually used or would use. Affiliate links do not influence which products appear or how they are described.

5. Third-party links

The Site contains links to external sites (Google reviews, Amazon, social media, manufacturer pages for recommended products). We are not responsible for the content, privacy practices, or terms of those external sites. Clicking an external link is at your own risk.

6. Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that information on the Site (including chemistry data, pricing ranges, and guide articles) is accurate, complete, or current.

Pool chemistry and DIY content: Our Pool School and Pool Chemistry Almanac pages are educational. Pool chemistry involves the handling of potentially hazardous chemicals. Use appropriate safety precautions. If you're not comfortable working with pool chemicals, hire a licensed professional. Nothing on the Site is a substitute for the judgment of a qualified pool technician inspecting your specific pool.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE POOL POLICE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100). Some jurisdictions don't allow these limitations; in those cases, liability is limited to the greatest extent permitted by applicable law.

Note: The preceding limitation applies to your use of the Site, not to our pool-service work. Any pool service we perform for you is governed separately by the terms we agree on when you hire us (verbally, by email, or in writing).

8. Indemnification

You agree to defend, indemnify, and hold harmless The Pool Police, its owner, and anyone acting on its behalf from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.

9. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Travis County, Texas.

10. Changes to these Terms

We may update these Terms from time to time. We'll revise the "Effective date" above. Your continued use of the Site after a change means you accept the updated Terms.
